Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and FortuniFi, LLC, a Michigan limited liability company (“FortuniFi,” “we,” “us,” “our”). They govern your use of the FortuniFi website and application (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to use FortuniFi. The Service is intended for personal, non-commercial use by residents of the countries where FortuniFi is offered (currently the United States, Canada, and the United Kingdom). FortuniFi is built for adults managing their own household finances and is not directed to anyone under 18. Any separate, future FortuniFi product for youth financial education would operate under its own terms and its own parental- and school-consent framework.
2. What FortuniFi is — and isn’t
3. Your account
You are responsible for keeping your login credentials secure and for all activity under your account. Use a strong, unique password and enable two-factor authentication. Provide accurate information and keep it current. Tell us promptly if you suspect unauthorized access. FortuniFi supports shared household (“couple”) accounts; if you invite someone to, or join, a household, you are responsible for the access you grant and should share only with people you trust.
4. Plans and billing
- Core budgeting and guidance features are offered free. An optional paid plan (“Plus”) adds features such as automatic bank sync and deeper reporting.
- The current prices, included features, trial length, and billing intervals are those shown at sign-up and checkout, which we may change from time to time with reasonable advance notice.
- Automatic renewal. Starting a paid plan authorizes a recurring charge to your payment method. Your subscription automatically renews at the end of each billing period — monthly or yearly, as you chose — at the then-current price, and your payment method is charged for the next period, until you cancel. If your plan includes a free trial, it converts to a paid subscription at the end of the trial unless you cancel before it ends. The renewal terms are shown to you at checkout.
- Payments are processed by Stripe; your card details are handled by Stripe under its terms, and we do not store your full card number.
- You may cancel anytime from your account. Access continues through the end of the current paid period, and — unless required by law or stated otherwise at checkout — amounts already charged for a started period are non-refundable.
- If a payment fails, we may retry it and may suspend paid features until it is resolved.
5. Your data and content
You retain all rights to the financial information and other content you enter or connect (“Your Data”). You grant FortuniFi a limited license to store, process, and display Your Data solely to operate and improve the Service for you, as described in our Privacy Policy. We do not sell Your Data and do not use it for advertising. You are responsible for the accuracy of what you enter; you can export or delete your data as described in the Privacy Policy.
6. Intellectual property
The Service — including its software, design, text, graphics, and the FortuniFi name and logo — is owned by FortuniFi and protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose while these Terms are in effect. You may not copy, modify, distribute, sell, or reverse-engineer any part of the Service, or use our branding, except as permitted by law or with our written permission.
7. Acceptable use
Don’t misuse the Service. You agree not to: use it unlawfully or access anyone else’s account without authorization; attempt to break, overload, probe, or reverse-engineer it; access data that isn’t yours; upload malware or harmful content; scrape or bulk-extract data; or resell the Service. We may suspend or terminate accounts that do.
8. Third-party services
FortuniFi relies on third parties including Stripe (payments), Plaid and potentially other financial-data aggregators such as Finicity or MX (optional bank connections), Cloudflare (hosting), Amazon Web Services (encryption-key management), Resend (transactional email), and Anthropic (the AI that powers optional features such as statement scanning and drafting a hardship letter or call script). Your use of those connections is also subject to their terms and privacy policies. When you connect a bank, you do so through the provider’s own secure flow — FortuniFi never receives or stores your online-banking username or password. We are not responsible for third-party services, and their availability or accuracy is outside our control.
9. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure, or if we discontinue the Service. On termination, your license to use the Service ends; sections that by their nature should survive — including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive. We handle your data after termination as described in the Privacy Policy.
10. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent permitted by law, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that any plan, projection, or figure is accurate or will produce a particular financial outcome. Bank-connection data comes from third parties and may be delayed or incomplete.
11. Limitation of liability
To the maximum extent permitted by law, FortuniFi and its owners, members, and operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from or related to your use of the Service. To the maximum extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or US $100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so — including liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by our negligence. If you are a consumer resident in the United Kingdom or the European Economic Area, we do not exclude or limit our liability for breach of the statutory rights the law gives you.
12. Indemnification
You agree to indemnify and hold harmless FortuniFi and its owners and operators from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms or applicable law, or your infringement of another’s rights.
13. Dispute resolution & arbitration
We’d rather fix problems directly: please contact us first and give us 30 days to work it out. If we can’t, you and FortuniFi agree that disputes relating to these Terms or the Service will be resolved by binding individual arbitration rather than in court — except that either party may bring a claim in small-claims court or seek an injunction for intellectual-property misuse. You and FortuniFi waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by notifying us in writing.
The binding-arbitration, jury-trial-waiver, and class-action-waiver provisions above apply only to users resident in the United States. If you are a consumer resident in Canada or the United Kingdom, they do not apply to you: any dispute will be handled by the courts of your country of residence under its consumer-protection laws, and nothing in these Terms requires you to arbitrate or to give up a right that your local law protects. (In Quebec, consumer arbitration clauses are not enforced.)
14. Governing law
These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. Subject to the arbitration section above, the state and federal courts located in Michigan will have jurisdiction over disputes not subject to arbitration.
If you are a consumer, nothing in this section deprives you of the protection of the mandatory consumer-protection laws of your country of residence, or of your right to bring proceedings in the courts of the place where you live. For consumers resident in Canada, your provincial law and Canadian federal law apply to the extent of your mandatory local rights; for consumers resident in the United Kingdom, the law of your home nation and UK consumer law apply to the extent of your mandatory local rights.
14a. Open banking — United Kingdom & Europe
If you connect a bank account and you are in the United Kingdom or the European Economic Area, that connection is provided through Plaid Financial Ltd. — authorised and regulated by the UK Financial Conduct Authority (FCA) as an Account Information Service Provider (AISP) under the Payment Services Regulations 2017, FCA reference number 804718. Plaid securely retrieves your account information from your bank on your behalf; FortuniFi receives that information solely to build and keep your plan current. Under open-banking rules you will be asked to re-confirm your consent roughly every 90 days, and you can withdraw consent and disconnect at any time — in the app or directly with your bank. Your use of Plaid is also governed by Plaid’s own terms and end-user privacy policy.
15. Changes to these Terms
We may update these Terms. For material changes we’ll update the effective date and take reasonable steps to notify you, such as an in-app notice or email. Continued use after changes take effect means you accept the updated Terms.
16. General
These Terms and the Privacy Policy are the entire agreement between you and FortuniFi about the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to an affiliate or successor. We may give you notices in-app or by email.
